BUSINESS TERMS AND CONDITIONS · The Agency provides an introduction between the family and the Au Pair. Whilst the Agency will make every reasonable effort to verify the integrity and suitability of an Au Pair, the Agency cannot be held responsible for any dishonest or malicious act by the Au Pair nor held responsible for the accuracy of the information provided by the Au Pair. · The Au Pair is not employed by the Agency, but by the family. The Agency shall not be liable under any circumstances for any loss, damage or expense incurred by the family or Au Pair, prior to, during or subsequent to the engagement of an applicant. · The client (family) shall pay the full placement fee before the commencement of employment of an Au Pair. No travel arrangements can be made until the full fee is received by the Agency. · The Agency offer a one-month probationary period beginning the day the Au Pair commences work with the family. If the family employs an Au Pair who is already in the U.K., and the placement fee is not received, the Agency will remove the Au Pair from the family. The guarantee is valid only if the full placement fee has been paid to the Agency. . All invoices to be paid within 7 days of date of issue. Failure to do so will incur a £50 late surcharge and interest at 4% above base rate of the accumulated outstanding fee per month. The probationary period is only valid if the full placement fee has been received by the Agency. . Should the invoice remain unpaid, the agency will instruct a debt collecting agency to deal with the debt and the client will be responsible for all ancillary costs. · In case of early termination (by either party) the Agency will offer an alternative Au Pair free of charge within the one-month probationary period (limited to one free replacement). Should the Agency be unable to fill the vacancy, or if the client does not require a replacement au pair, a refund will be made. (Please note scale of refunds. See Fees). · If the Au Pair leaves the family after the one-month probationary period has elapsed, the Agency will find a replacement, for which a three-month placement fee will be charged until the 5th month. Thereafter, a full fee will be payable. · The Agency cannot be held responsible for early termination by either party. · Should the Au Pair stay with the host family for a longer period than originally agreed upon, a further fee will become payable dependant on the duration of the subsequent stay. (See Fees). · If either party wishes to terminate the contract, one weeks' notice must be given. During this time the Au Pair should be allowed to continue living with the family and should carry on their normal duties and receive pocket money, as usual. The Au Pair must not be made to leave the family home immediately unless criminal activity has taken place in which case the Agency and Police must be informed. · The Agency cannot be held responsible for the accuracy of information provided by the Au Pair. All information provided by the family and Au Pair is strictly confidential. · The terms stated on the Registration Forms will form a contract between the family and the Au Pair of which the Au Pair will have a copy. The Terms and Conditions of the Hungarian Au Pair Agency will be deemed as accepted by the family by completion of the Registration Form. · The family should understand that the Au Pair arrangement is a cultural exchange and not a contract of work. Au Pairs should be treated as a member of the family and not as hired help. It is the families' responsibility to show initiative, to integrate the Au Pair into their family life, help with English learning and any other difficulties that may arise. · The family should regularly communicate with their Au Pair to make sure there are no problems. The Agency is happy to assist at any time with such communications.
